TERMS OF SALE

The owner of the website www.nepeta.it aimed at the online sale of products is Nepèta Srl with headquarters in Viale Teracati 128, 96100 Siracusa SR.

All orders placed through the site are governed by the following conditions of sale.

Nepèta Srl reserves the right to modify them at any time, therefore the applicable conditions of sale will be those in force at the time the order is placed. By placing an order, you declare that you have read, understood and accepted these conditions of sale.

Orders are accepted only for delivery within Italy.

REGISTRATION

To place orders you must be registered and the information that the customer enters must be correct, complete and updated promptly in case of change of address or other mandatory data.

The password that the customer will enter at the time of registration is strictly personal and confidential and must not be disclosed to third parties. The customer is responsible for the use of the password and for the orders forwarded through it, even without his knowledge. If you know or suspect that someone else knows or is using your password, we ask you to inform Nepèta Srl immediately by email to info@nepeta.it

By registering, the customer consents to the processing of his/her personal data in accordance with the provisions of the law on the protection of personal data n. 675/96 and subsequent updates.

ORDERS

Due to the possibility of multiple purchases by multiple users at the same time, Nepèta Srl, once the order has been received, reserves the right to verify the availability of the goods and, in the absence of this, to promptly communicate the non-acceptance of the order sent.

Once orders have been transmitted to the system, they can no longer be modified or blocked, therefore it is your responsibility to ensure that they are correct before confirming them.

For each order placed, a summary email is sent to your email inbox. This confirmation message will reiterate all the data entered by the customer.

PRICES

The prices indicated for the products displayed are to be understood as VAT included. Shipping costs are not included, they are invoiced on the basis of the rates indicated on this site on the date on which you transmitted the order. The prices and offers on the site are valid only for online purchases. Prices in the store may be different from those shown on the site

PAYMENTS

Payments are accepted by bank transfer, credit card and PayPal. Alternatively, payment on delivery (cash on delivery, cash only) is accepted with additional costs indicated on the site at the time of ordering.

DELIVERY OF GOODS

Shipments will be made via express courier, delivery approximately within a maximum of 30 days from the transmission of the order except for unavailable goods.

In the event that a product is not available, the consumer will be informed promptly and, if payment has already been made, will be promptly refunded.

Orders will be delivered to the shipping address specified by the customer at the time of ordering, it is recommended that someone is always present at this address to collect the goods. Please indicate in the notes all the information you consider useful to help us with the delivery. However, it is not possible to indicate a precise delivery time, which is at the discretion of the shipper from Monday to Friday during normal working hours.

It is the customer's responsibility to verify the quantity and good condition of the goods at the time of delivery, the number of packages received and their integrity. In the event of obvious damage to the packaging or the lack of any packages, the customer must reject the goods or accept them by signing the transport document presented by the forwarder "with reservation" and specifying the damage found.

The consumer undertakes to check without delay, and in any case no later than 3 days after receiving the products, that the delivery complies with the order and to inform the seller within this period of any defect in the products received or their non-conformity with the order placed. This communication can be made via e-mail to info@nepeta.it or at +39 0931 573180.

In case of missing items in the package, they will be sent back to you at our expense, once the shortage has been ascertained. Alternatively, if not available in our warehouse, you will be credited the amount relating to such items

In the event of a defect or fault inherent to the product, we will replace the product at our expense or refund the amount paid.

In any case, the legal guarantee of conformity of the seller applies pursuant to and for the purposes of European Directive 44/99/CE and Italian Legislative Decree no. 206/2005 (Consumer Code).

LIABILITY FOR DAMAGE FROM DEFECTIVE PRODUCTS

In the event of damage caused by defective products, the provisions of European Directive 85/374/EEC and Italian Legislative Decree no. 206/2005 (Consumer Code) apply. Nepèta Srl, in its capacity as distributor of the products through the website www.nepeta.it, releases itself from any liability, none excluded, indicating the name of the relevant manufacturer.

RIGHT OF WITHDRAWAL

The right of withdrawal applies only to goods that are intact at the time of return.

Pursuant to Legislative Decree 206/2005 (Consumer Code) on distance selling, the consumer has the right to withdraw from the purchase contract for any reason and without providing explanations. The right is exercised by sending a written communication by registered letter with acknowledgement of receipt within 10 working days of receiving the goods. The communication can also be sent, within the same period, by email to the address info@nepeta.it provided that it is confirmed within 48 hours by registered mail with acknowledgement of receipt addressed to Nepèta Srl, Viale Teracati 128, 96100 Siracusa (SR). This communication must contain the description of the products that you intend to return, also providing the methods of crediting the refund and any bank details. The products subject to withdrawal must be returned at the expense of the consumer, intact, to the same address. Once the goods have been received and their integrity verified, we will credit the customer with the cost of the returned products but not the shipping costs incurred by the consumer for the return.

TAX COMPLIANCE

At a national level, for online sales via the Internet to private customers, there is an exemption from issuing an invoice (art. 22, paragraph 1, DPR 633/72), as well as certification of the consideration (receipt and receipt) as per art. 2 DPR 696/96. The invoice is issued only if requested by the buyer at the time of purchase, communicating the necessary data (name, surname, address and tax code). In the case of subjects holding a VAT number, please communicate it when placing the order.

FORCE MAJEURE

Nepèta Srl will not be liable in the event of delays or failure to deliver caused by events beyond its reasonable control, such as strikes, wars, natural disasters and restrictions on the courier's traffic and any other event that makes the production, transportation or delivery of the products impracticable.

For anything not specifically indicated in these conditions, reference is made to Legislative Decree 206/2005 regarding the protection of consumers in relation to distance contracts.

For any dispute relating to the contract in question, the Court of Syracuse will have exclusive jurisdiction.
